El marco legislativo actualmente vigente está constituido por la Ley Nº 28879, de 18 de agosto de 2006, de Servicios de Seguridad Privada,[5] y reglamentado por el Decreto Presidencial Nº 003-2011-IN, de 31 de marzo de 2011.[6] De aprobarse, el Proyecto de Ley 04300/204-PE, derogará la primera e introducirá un nuevo marco legislativo[7].
Desde 2012, la SUCAMEC es la autoridad competente para autorizar los servicios de seguridad privada y la regulación de las armas pequeñas[11]. La SUCAMEC tiene el mandato explícito de preservar la paz, la seguridad y el bienestar social de todos los ciudadanos[12].
En comparación con su predecesora la DICSAMEC, la SUCAMEC se ha vuelto más técnica y especializada y ha ganado más autonomía administrativa, funcional y económica respecto al Ministerio del Interior. La ley de seguridad privada vigente sigue refiriéndose a la DISCAMEC como autoridad competente[13] El proyecto de ley mencionado responde a los cambios institucionales y ofrece un nuevo marco para la nueva autoridad competente SUCAMEC.
Las personas jurídicas y naturales que deseen prestar servicios de seguridad deben solicitar autorización a la SUCAMEC. Cada tipo de servicio requiere una licencia diferente. A continuación, la SUCAMEC realiza una evaluación, que incluye visitas a los lugares donde se desarrollará la actividad del respectivo solicitante, comprobando el cumplimiento de las normas de seguridad[14] Las licencias tienen una validez de 5 años para las personas jurídicas y de un año para las personas físicas, renovables, y pueden ampliarse geográficamente a otras regiones del país[15].
